OKs partial suit settlement

A man suing the city of Covington for wrongful incarceration is one step closer to getting a settlement.

An ordinance unanimously passed by a 5-0 vote of the Covington City Council approving execution of a promissory note as partial settlement of litigation in the case of Dennis Patrick Brown versus the city of Covington.

Brown has been absolved through DNA testing of a crime for which he was convicted and served 20 years in prison.

The city of Covington’s promissory note will be in the amount of $300,000 to be paid in 10 annual installments.

The ordinance, passed Friday morning in a special emergency meeting, states the economic settlement is in the best interests “to preserve future resources” of the city. Acceptance of the settlement will release the city from all claims against it and former employees upon the payment of insurance proceeds and the additional $300,000.

The amount of the insurance proceeds was not discussed at the meeting.

The ordinance also stated “the city is advised by its city attorney that failure to settle under these terms may place the city at risk for far greater financial exposure without the benefit of payment over time.”

City Attorney Deborah Foshee had no comment about the case, which is still pending.

Ten payments of $30,000 each will be made annually. The only interest applicable to the payments are a late charge of 8 percent daily interest on the unpaid amount until paid.
